What Trump’s Anti-Trans Executive Order Means

What Trump’s Anti-Trans Executive Order Means

“There are only two genders, male and female.” These are the words of newly sworn US president Donald Trump. While such sentiments are not new to Donald Trump, many wonder what Trump’s Anti-Trans Executive Order means for the LGBTQ+ community. Let’s dive in.

Trump’s New Executive Order on Diversity and LGBTQ+ Rights

A few hours after being sworn in, US President Donald Trump signed an executive order that signals his administration’s opposition to transgender identity. Following the signing of this executive order, Trump has proved that he’s keen on re-establishing transgender policies that were in place during his first term. One of the notable policies is the housing of trans people in federal prisons based on the gender assigned at birth.

In his inaugural statement, Trump said that from now on, the official position of the United States is that there are only two genders: male and female. This, he says, is how he will protect women from radical gender ideology and return to American values.

The executive order goes contrary to one issued during Biden’s administration that allowed trans people to update their gender markers on federal identification. Of course, the federal government has no power over how people identify themselves. Still, it has control over whether trans people can receive federal documents that match their gender identity, including Social Security Identity cards, passports, etc.

While the order has received praise from conservative groups like the American Family Association, others like the American Medical Association, the American Psychiatric Association, and human rights activists view gender as a spectrum that consists of more than males and females.

What Trump’s Anti-Trans Executive Order Means for Trans People

During the campaigns, Trump promised to roll back Biden administration policies that focused on the implementation of diversity measures across the federal government. True to that, Trump repealed 78 executive orders from the previous administration, including those supporting racial equity and fighting discrimination against LGBTQ+ individuals upon his swearing-in for the second term.

Trump Revoked Biden’s Executive Order on Trans

Like Trump, on the first day of his administration in January 2021, Biden signed two major orders: One for combating discrimination based on sexual orientation and another that supported racial equity for marginalized communities. These are among the orders that Trump rescinded on his first day in office.

The LGBTQ+ community and human rights activists say the move could erase the fundamental rights and freedoms that LGBTQ+ individuals have gained over time. For example, removing all federal protections for trans people and limiting access to the necessary medical care could put the transgender community in life-threatening danger and medical issues.

The Trump effect on transgender will likely go beyond the medical issues. Trump will likely partner with anti-LGBTQ+ organizations and appoint conservative judges which could impact trans fundamental human rights and freedoms.

Revoking the Medicaid and Medicare eligibility for healthcare providers that offer gender transition care, would mean that thousands of youths across the country won’t receive that treatment, impacting their general well-being and mental health.

When the Trump policies take shape, we expect an increase in the number of states that propose or pass laws that target LGBTQ+ people and trans kids. In some instances, we could see trends where trans children are denied access to sports or appropriate bathroom facilities.

As it stands, transgender children cannot access gender-affirming medical care in the majority of US states, which increases their chances of experiencing mental stressors of gender dysphoria as their bodies change.

What to Expect

  • Inaccurate documents will expose trans people to harassment and discrimination
  • Reduced global trans advocacy
  • Reductions on gender-affirming care and healthcare for LGBTQ+ individuals
  • Limited federal protection for transgender children
  • Increased scrutiny on inclusion and diversity initiatives
  • Conservative judicial reforms that affect LGBTQ+ rights in employment and public initiatives

Expect a Backlash Following Trump’s Anti-Trans Executive Order

We don’t expect Trump’s anti-trans executive order to go on without a challenge. The president and CEO of The Leadership Conference on Civil and Human Rights, Maya Wiley argues that policies by the new administration will drain away gains from the 75 years of work of the civil and human rights coalition. We expect more human rights groups to come forward to fight these new policies.

The Mental Impact

Away from politics, one of the most critical things is what these policies will have on the LGBTQ+ community. Lack of access to the right bathroom facilities, discrimination in employment, and lack of gender-affirming medical care could lead to mental health issues for LGBTQ+ children, their parents, and their allies.

At LGBTQ and ALL, we’ll continue to support these individuals to ensure they can find the necessary mental support and healthcare.
